SALES TERMS AND CONDITIONS

 

 

ORDERS AND PRICES

Sales shall be finalized only by written acceptance of EUROMOTOR.US. Orders must be sent by customers in writing in their own letter head and must be received by fax, or e-mail.

Prices will be confirmed in accordance to the validity of the relevant offer, by means of our “confirmation of orderâ€.

 

DELEVERY TERMS

The delivery date is approximate and the delayed execution of orders shall not give rise to any right to indemnities, contract cancellation or reduction, unless specifically agreed at the time of ordering.

EUROMOTOR.US declines any responsibility for delays in delivery due to the means of transportation, or to force majeure.

 

DISPATCH AND TRANSPORT

Goods shall in every case be carried on behalf, and at the sole risk of the buyer, even if sold or dispatched carriage free.

In case of shortage or damage, the buyer shall get the ascertainment of the carrier and write his own reserves on the damage report obtained by the carrier itself. Such reserves shall be confirmed by register within 3 days from delivery date of the goods.

 

NON-CONFORMANCES AND CLAIMS

No claim shall be taken into consideration if not made within eight (8) days from receiving the goods.

 

RETURNS OF GOODS

Any goods supplied against proper orders and received in good order shall only be returned to our warehouse under written authorization by the sales department of EUROMOTOR.US. Carriage costs and risks shall be borne by customer.

 

PAYMENT

Payment shall be valid only if made directly to the registered office of EUROMOTOR.US. Any payment made before expiry of the agreed terms shall not rise to any right of the buyer to demand a discount or to withhold parts of the payments. On expiry of the terms for payment, the buyer shall lose the right to the agreed discount, if any. Any delay in payment shall constitute non-fulfillment of the contract and entitle the seller to discontinue supplies.

 

RETENTION OF TITLE

All goods delivered remain our property until the goods have been fully paid for. Until payment has been effected, the buyer is not authorized to cede the goods in bailment or as guarantee for credit. In the event of regular resale of the goods, the derived credit shall be considered assigned to us.
